The following terms and conditions listed below will apply between you and descent-world for the sale and purchase of the items contained in your cart. The terms do not affect your statutory rights.

All rights, including copyright, in the content of these descent-world shop web pages are owned or controlled for these purposes by descent-world. In accessing the descent-world shop’s web pages, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of these descent-world shop web pages for any other purpose whatsoever without the prior written permission of the descent-world.

The descent-world shop conforms to the UK Data Protection Act. Any information you provide is treated in strict confidence and is stored in a secure location. Customer’s details will not be disclosed in any way to any persons outwith the descent-world shop.

Validity

By ordering a product you accept these terms and conditions. The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes.

Orders

All orders are subject to acceptance and product availability. descent-world aims to ensure that the pricing of products on the web pages is correct at all times, however, the web pages may not accurately reflect the correct details at the moment at which you place your order. descent-world cannot confirm the price of a product until your order is accepted on despatch and descent-world reserves the right to change prices without prior notice.

Availability of Goods

All in stock items are usually despatched within 48 hours. Some of our goods our dispatched directly to you from our manufacturers, so please allow up to 28 days for delivery, however our experience is much less than that. If descent-world or our suppilers have insufficient stock to deliver the goods you have ordered. Descent-World will then inform you by e-mail at the address given in your order form and any sum which may have been credited from your credit card/PayPal will be re-credited to you within 30 days of the date of your order. Delivery is free to the UK & Ireland only. Shipping to other EU countries is charged at £2.00 GBP. North American Orders are more complicated and therefore more expensive at £10.00 GBP.

Your undertakings and warranties

You warrant that the information given on your order form is complete and accurate.

Acknowledgement of Order

When you have completed your order you will be sent an e-mail confirming your order. It will state what the products are, the cost (including VAT and P&P) and delivery and invoice details. If your order has been unsuccessful you will be made aware of the reason why and possible explanations.

In the event of any change e.g. in price or expected delivery date between completion of your order, we shall inform you and you shall at that point have the right to either (i) accept such change (in which case your email reply will represent a new offer which we will accept upon notification of despatch) or (ii) reject such change (in which case your email reply will represent a withdrawal of your order, or the relevant part of your order as the case may be).

Payment

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and descent-world will not be liable for any delay or non-delivery.

Returns

Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from descent-world shop. You will have the right to cancel your order within seven working days of delivery (starting the day after you receive the goods). This is a UK statutory right and will apply to your order unless your order video, DVD, audio, multimedia or software products and the product seal has been broken.

Should you proceed to order you will have the right to cancel for the purchase of any item from the time it is ordered to within seven working days of delivery (starting the day after you receive the goods). This is a UK statutory right and is separate and additional to our full returns policy. This will apply to your order unless you order video, DVD, Audio, Multimedia & Software products and the item has been unsealed. Should you cancel the contract we will then refund you the price you have paid for the goods less standard delivery costs or a special delivery service. You are under a duty to take reasonable care of the goods, which means the goods must be unused. Should you order, details of this right will be sent to you with your confirmatory e-mail.

Force majeure

Descent-World shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Limitation of Liability

Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction, however nothing in these terms and conditions shall exclude or limit descent-world’s liability for death or personal injury as a result of descent-world’s negligence.

Invalidity of Terms and Conditions

If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.
